Embu Senator Alexander Munyi Mundigi has pushed back against a decision by the Democratic Party of Kenya (DP) to expel him over his role in campaigning for and supporting Leonard Muthende in the recently concluded Mbeere North Constituency by-election.

During the fiercely contested parliamentary race, Leonard Muthende of President William Ruto’s UDA won the seat after edging out DP candidate Newton Kariuki. Muthende secured 15,802 votes, narrowly beating Kariuki, who garnered 15,308 votes.

Following Kariuki’s defeat, DP wrote to Senator Munyi informing him of its intention to expel him for supporting and aligning himself with the policies of a rival party, UDA.

The party accused its only senator of gross misconduct and violating party rules, as well as Section 148 of the Political Parties Act.

“You have continued to publicly support activities, positions and events associated with the Kenya Kwanza Coalition (KK), notwithstanding the Democratic Party’s withdrawal from the coalition and contrary to party directives requiring all members to act in alignment with Democratic Party resolutions,” reads a letter signed by Dr Haji.

The party further informed him that, under Article 8, Section b(iv) of the Democratic Party Constitution, a member may be deemed to have resigned or face disciplinary action if he or she forms or joins another party, campaigns for another political party, promotes the ideology, interests, or policies of another party contrary to the law or party policy, or acts against the aims, policies, and objectives of DP.

Through the same communication, the party directed Senator Mundigi to immediately stop all activities, endorsements, and public statements that contradict its official position.

In his response, Mundigi said that on March 12, 2025, party leader Justin Muturi politically exited the Kenya Kwanza coalition and that “presumably the party ceased working with and under the memorandum of understanding entered into before the 2022 General Election at the formation of the coalition.”

Mundigi, who serves as the DP deputy party leader, said he has consistently remitted Ksh10,000 to the party every month. He added that he and Public Service Cabinet Secretary Geoffrey Ruku were the only elected leaders on a DP ticket who made the monthly contributions, alongside three Members of County Assembly.

He noted that Mr Ruku stopped remitting the contributions after his appointment to the Cabinet.

Mundigi said he will continue backing the ruling Kenya Kwanza coalition, of which DP remains a member.

The senator said the party’s top decision-making organs have yet to meet or formally approve any move to exit the Kenya Kwanza coalition under President William Ruto’s leadership. He added that DP communicated the decision to remove him through his personal assistant while he was on official duty outside the country.

To avert his imminent removal from the party, Mundigi has sought the intervention of the Political Parties Disputes Tribunal.

The party also gave him 72 hours to renounce his association with the Kenya Kwanza Coalition and reaffirm his loyalty and commitment to DP, on whose ticket he was elected during the August 2022 General Election. The party warned that failure to comply would trigger disciplinary action.

Through his lawyer, Mundigi said he had not violated any DP laws, arguing that the party remains part of the Kenya Kwanza coalition.

“Subject to Articles 9 and 10 of the party’s Constitution and by-laws, the top organs, namely the National Delegates Committee (NDC) and the National Governing Council, must meet and pass a resolution to formally exit a coalition government, in which the party is currently part of the larger Kenya Kwanza alliance,” Senator Mundigi stated.
